LEGAL BASIS: Under California Business & Professions Code Section 7113, failure to complete a construction project for the stated price without legal excuse is grounds for discipline. Under B&P 7159, you are obligated to complete all work specified in our home improvement contract.
DEMAND: I demand that within ten (10) days you either:
Option A: Return to complete all remaining work per our contract; OR

Option B: Refund [Amount Demanded], which represents the cost I will incur to have another licensed contractor complete this work.
If you fail to respond, I will file a CSLB complaint, claim against your bond, and pursue legal action for all damages.

What Counts as "Incomplete"?

  • Work specified in contract but not performed
  • Missing components (ridge caps, flashing, vents)
  • Cleanup not done (debris, materials left behind)
  • Final inspection not obtained
  • Warranty paperwork not provided

⚠ Withholding Final Payment

If you haven't made final payment, you have leverage. Under California law, final payment is not due until work is "satisfactorily completed." Document the incomplete items and withhold proportional payment.

Failure to complete any construction project for the price stated in the contract without legal excuse constitutes grounds for discipline.

B&P Code Section 7159.5 - Payment Schedule

Final payment is not due until the project is completed to the homeowner's satisfaction. Contractor cannot demand final payment for incomplete work.
