Civil Code 1793.2

Mileage Offset Formula

  • Offset = (Miles at first repair / 120,000) x Purchase Price
  • Only miles BEFORE first defect report count
  • Cannot exceed purchase price

2026 Lemon Law Updates

New laws and trends affecting California lemon law claims - Updated February 9, 2026

SB 26: Manufacturer Opt-Out Provision

  • New provision allows manufacturers to opt out of certain third-party warranty claims
  • Applies to aftermarket or extended warranty disputes, NOT to original manufacturer warranties
  • Song-Beverly Act protections for factory warranties remain fully intact
  • Tip: If a manufacturer cites SB 26 to deny your claim, verify whether your warranty is a factory warranty - if so, SB 26 does not apply

CARS Act (Federal) - October 2026

  • Federal CARS Act takes effect October 2026, requiring dealers to disclose vehicle history more thoroughly
  • Dealers must provide written disclosure of known defects, prior damage, and repair history before sale
  • Strengthens fraud claims when dealers fail to disclose material vehicle history
  • Tip: After October 2026, any dealer who sells you a vehicle without proper history disclosure faces federal liability in addition to state lemon law claims

ACC II EV Battery Warranty Rules

  • California now requires minimum 8-year / 100,000-mile warranty on EV batteries
  • Battery replacement threshold: if capacity drops below a set percentage, manufacturer must replace under warranty
