Top 6 "Gotcha" Provisions

HIGH PRIORITY

1. State Restrictions Can Forfeit Winnings

HIGH RISK
If you play cash games from a restricted state (even temporarily while traveling), Skillz reserves the right to void your entries, forfeit your winnings, and terminate your account without refund.
"Users who access the Platform from jurisdictions where cash-enabled games are prohibited may have their accounts suspended and any winnings forfeited."

2. Binding Arbitration with Class Action Waiver

HIGH RISK
Disputes must go to individual arbitration—you cannot sue in court or join class actions. The opt-out window is only 30 days from account creation.
"You agree that any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration... You waive any right to participate in a class action lawsuit."

3. Account Termination for Skill Discrepancy

MEDIUM RISK
Skillz monitors for "skill manipulation" where your performance deviates from your established pattern. This can trigger fraud investigation and account suspension even without cheating.
"We may suspend accounts that exhibit unusual skill patterns or performance inconsistencies pending investigation."

4. No Refunds on Virtual Currency

MEDIUM RISK
Deposits used to purchase Ticketz (virtual currency) and Z Coins are non-refundable. Even if you never play, unused deposits cannot be withdrawn without first being "played through."
"All purchases of Ticketz are final and non-refundable except as required by applicable law."

5. Prize Pool Rake Up to 18%

MEDIUM RISK
Skillz takes a platform fee (rake) from prize pools, typically 14-18%. This means in head-to-head matches, you need a win rate above 54-56% just to break even.
"Skillz charges a service fee on each entry, which is deducted from the prize pool before distribution to winners."

6. Tax Reporting Above $600

INFO
Skillz reports net winnings above $600/year to the IRS via Form 1099-MISC. You're responsible for taxes on all winnings regardless of whether you receive a 1099.
"We will report your net winnings to the IRS if they exceed $600 in a calendar year. You are responsible for all applicable taxes."
