  • Above the submit button: Place the checkbox and disclosure where users will see it before submitting the form.
  • Clear and conspicuous: Use readable font size (at least 12px), contrasting colors, and adequate spacing.
  • Unchecked by default: The checkbox must be unchecked when the form loads. Pre-checked boxes are not valid consent.
  • Optional consent: Do not require the checkbox to submit the form unless the communication is essential to the service.
