Rescission is the legal right to cancel a contract and return to your pre-contract position. For timeshares, this means you can cancel the purchase, receive a full refund of all payments, and walk away with no further obligation. The rescission period typically begins when you sign the contract or receive the required disclosure documents, whichever is later.

⚖ Legal Basis for Timeshare Rescission
Timeshare rescission rights come from state statutes, the Interstate Land Sales Full Disclosure Act, and FTC consumer protection rules. Understanding these laws helps ensure your rescission is effective.
State Timeshare Acts
Florida Stat. § 721.10: 10-Day Rescission Period
Florida provides a 10-day rescission period from the date of execution of the purchase contract or receipt of the public offering statement, whichever is later. Developer must refund all payments within 20 days of receiving the rescission notice.
California Bus. & Prof. Code § 11238: 7-Day Rescission Period
California grants 7 days to cancel from the date of signing or receipt of the public report, whichever is later. Refund must be made within 30 days. Contract must prominently display rescission notice in at least 12-point bold type.
Nevada Rev. Stat. § 119A.420: 5-Day Rescission Period
Nevada allows 5 calendar days to cancel. The rescission period begins on the date of signing or receipt of required disclosures, whichever is later. Developer must refund within 30 days of receiving rescission notice.
Arizona Rev. Stat. § 32-2197.08: 7-Day Rescission Period
Arizona provides 7 days to cancel from contract execution or receipt of the public report, whichever is later. The developer must refund all payments within 45 days of receiving the cancellation notice.
Federal Protections
Interstate Land Sales Full Disclosure Act (15 U.S.C. § 1703)
For timeshares marketed across state lines, ILSA requires developers to provide a detailed property report. Buyers have 7 days to cancel after receiving the report. Failure to provide the report can extend rescission rights indefinitely.
FTC Act Section 5 (15 U.S.C. § 45): Unfair or Deceptive Practices
High-pressure sales tactics, misrepresentations about resale value, rental income, or investment potential, and failure to disclose material facts can constitute FTC violations supporting rescission beyond the statutory period.
