Three Qualification Pathways
👤 SSA Disability Determination

⚠ Post-Discharge Monitoring Period
After discharge approval, you enter a 3-year monitoring period. During this time, you cannot earn above poverty line income or receive new federal student loans. Violating these conditions results in loan reinstatement.
⚖ Legal Basis for TPD Discharge
34 CFR 685.213 - Total and Permanent Disability Discharge
Federal regulations establish three pathways for TPD discharge and specific documentation requirements for each. The Department must approve discharges when regulatory requirements are met. Denials based on incomplete applications must allow opportunity to cure deficiencies.
20 USC 1087(a) - Discharge Provisions
Higher Education Act authorizes discharge of federal loans for borrowers who become totally and permanently disabled. This statutory right cannot be denied based on administrative technicalities when substantive requirements are met.
