Cosigner Release Denial Overview
Many private student loan borrowers are contractually entitled to cosigner release after making consecutive on-time payments (typically 12-48 months) and meeting credit and income requirements. However, lenders frequently deny release requests based on subjective criteria or undisclosed requirements not in the original loan agreement.
If you've made all required payments, meet the stated credit score threshold, and have sufficient income as defined in your loan agreement, the lender's denial may constitute breach of contract.

Dear [Lender]:
I demand immediate cosigner release on the above-referenced private student loan. I have met all requirements specified in my loan agreement dated [date], and your denial of my cosigner release application constitutes breach of contract.
REQUIREMENTS MET:
According to Section [X] of my loan agreement, cosigner release is available after:
1. [X] consecutive on-time payments: I have made [X] consecutive monthly payments without any late payments, as documented by my payment history.
2. Minimum credit score of [X]: My current credit score is [your score], which exceeds the required threshold. I have attached my credit report showing this score.
3. Debt-to-income ratio below [X%]: My current DTI is [your DTI]%, calculated as monthly debt payments of $[amount] divided by gross monthly income of $[amount]. I have attached pay stubs and debt documentation.
4. Graduation and degree completion: I graduated from [school] on [date] with a [degree]. Diploma attached.
I have satisfied every requirement stated in the loan agreement. Your denial letter cites [denial reason], which is not a requirement listed in my loan contract.
BREACH OF CONTRACT:
Your refusal to release my cosigner despite my satisfaction of all contractual requirements constitutes breach of contract under [state] law. The loan agreement creates a binding obligation to release the cosigner when I meet specified criteria. You cannot add new requirements or apply subjective standards not stated in the contract.
DEMANDED RELIEF:
I demand that you:
1. Immediately release [cosigner name] from all liability on this loan
2. Provide written confirmation of cosigner release within 15 days
3. Update credit bureau reporting to remove cosigner
4. Cease reporting this debt on my cosigner's credit reports
If you do not release my cosigner within 15 days, I will:
- File a complaint with the Consumer Financial Protection Bureau
- File a complaint with [State] Attorney General
- Pursue litigation for breach of contract and unfair trade practices
- Seek damages including attorney fees and credit harm to my cosigner
My cosigner and I have fulfilled our obligations. You must honor your contractual commitment.
