California Small Claims Court Overview

California Small Claims Court provides a simplified, affordable way to resolve disputes without attorneys. Governed by California Code of Civil Procedure Sections 116.110-116.950, small claims court is designed for self-represented parties to present their cases directly to a judge.

Key Benefit: No attorneys are allowed in small claims court (except in specific circumstances like appeals). This levels the playing field between individuals and businesses, and keeps the process accessible to everyone.

Important: If your claim exceeds the small claims limit, you can "waive" the excess and still file in small claims court. For example, if you're owed $15,000 as an individual, you can sue for $12,500 and waive the remaining $2,500. You cannot later sue for the waived amount.

California small claims court filing fees vary based on the amount of your claim. These fees are set by the Judicial Council and are current as of 2024.
