Quick background on my situation — any input appreciated.

fired while on medical leave. I've been dealing with this for about 5 months now and the situation isn't improving.

I have worked at this company for 1 years. My position is non-exempt and I do not have a written employment agreement beyond the standard offer letter.

What are my legal options here? Is it worth pursuing?

Licensed attorney — a few thoughts. Here's my take on the legal issues.

This is a common situation and the law is fairly clear. Under the FLSA and state wage laws, compensable.

One important thing — there are strict deadlines for filing these claims. Don't wait too long.

I went through almost the exact same thing.

What worked for me was filing with the appropriate government agency. It took 4-8 months but was worth it.

Just want to point out — the statute of limitations might be a factor here. In some states it's as short as 1-2 years. Don't sit on this too long.

NAL, but from what I've read, you should file a complaint. That said, definitely get a lawyer to look at the specifics.

One thing worth mentioning: if the other party violates a settlement agreement, you can go back to court for enforcement. Make sure any settlement is in writing and signed by all parties. Verbal agreements are much harder to enforce.

Pro tip: if a company is violating your rights and you need legal help but can't afford it, check if any law school clinics in your area handle your type of case. Law students (supervised by licensed attorneys) provide free legal services and are often very thorough because they're learning.
