NO. CA Labor Code 202: if you give 72+ hour notice, final paycheck is due ON YOUR LAST DAY OF WORK. you gave 2 weeks. they're already 3 weeks late.
waiting time penalties under Lab Code 203: one day's wages per day late, up to 30 days. file a wage claim with DLSE. you'll likely get the wages + 30 days of penalties.
+1 to DLSE. it's free and effective. employers HATE wage claims. usually settle quickly. attorney not required.
I'm Sergei Tokmakov, California attorney (Bar #279869). The advice above is correct. CA Labor Code 202(a) explicitly requires immediate payment of all wages owed at the time of voluntary quit if you gave 72 or more hours of notice. Vacation accrual must also be paid out as wages.
Waiting time penalties under Lab Code 203 are calculated as one full day's wages for each day late, up to 30 calendar days. At a typical $200-300/day rate, that's $6,000-$9,000 on top of your owed wages. Penalties are mandatory if the failure was willful (which 3 weeks late typically establishes).
File at the DLSE — claims are simple, free, and resolved in 60-90 days. Informational only.
