F-1 OPT STEM extension — employer not E-Verified

I'm on post-completion OPT with a STEM degree (computer science). My OPT EAD expires on April 22, 2026 — that's exactly 60 days from now. I want to apply for the 24-month STEM OPT extension, but there's a problem: my employer is not enrolled in E-Verify.

I've brought this up with HR multiple times over the past few months. They keep saying they'll "look into it" but nothing has happened. It's a small startup, about 30 employees, and they've never had an international employee before me. I don't think they understand the urgency.

What are my options here? Can I apply for the STEM extension while they're in the process of enrolling? Or do I need to find a new employer? I love this job and don't want to leave but I also can't lose my work authorization.

This is time-sensitive and you need to act now. Let me lay out the requirements and your options clearly.

The E-Verify Requirement (8 CFR 214.16): To qualify for the STEM OPT extension, your employer MUST be enrolled in E-Verify at the time the I-983 Training Plan is signed. This is a hard regulatory requirement — there's no exception or waiver. The employer's E-Verify company ID number goes on the I-983 form, and USCIS verifies it.

Timeline for E-Verify Enrollment: The good news is that E-Verify enrollment is relatively quick. Most employers can complete enrollment in 3-5 business days through the E-Verify website (e-verify.gov). It's free. There's an online tutorial, a memorandum of understanding to sign, and then they get a company ID number. Your employer needs to do this immediately — not next week, NOW.

Filing Deadline: You must file the STEM OPT extension (I-765 with Form I-983) up to 90 days before your current OPT expires and no later than the expiration date. Since your OPT expires April 22, your window is now through April 22. But you need the employer to be E-Verified first.

Talk to your employer's leadership — not just HR — today. Frame it as: "This takes 30 minutes of your time and costs nothing. If it doesn't happen in the next 2 weeks, I will lose my ability to work for you and you'll need to replace me." That usually gets attention.

I talked to my CEO directly today (bypassed HR). He was actually very responsive — said he didn't realize the urgency and that HR had been dragging their feet. He's going to start the E-Verify enrollment himself this week. If it only takes 3-5 days, I might still be okay on timing.

Question: if worst case they don't get enrolled in time, what happens if I find another employer who IS E-Verified and switch jobs? Can I still apply for STEM OPT through a new employer?

Yes, you can switch employers and file the STEM OPT extension through a new E-Verified employer. The STEM extension is tied to the employment relationship, not a specific employer. You would need a job offer from the new employer, complete a new I-983 Training Plan with them, and file the I-765 before your current OPT expires.

If you go this route, keep in mind the cap-gap issue — if you're also hoping for H-1B selection for FY2027, your cap-gap extension only applies if you have valid OPT status at the time of the H-1B filing. So maintaining continuous OPT status is critical.

Hopefully your CEO follows through and this becomes moot. But it's smart to have a backup plan. Start discreetly looking at E-Verified employers in your field just in case. You can search the E-Verify employer database to verify enrollment before applying.

Was in almost your exact situation last year. Small company, they had no idea what E-Verify was. Here's what I did: I literally wrote a step-by-step guide for my HR person with screenshots of the E-Verify enrollment process and sat next to them while they did it. Took about 45 minutes total including the online tutorial. They got the company ID the next business day.

Don't assume HR will figure it out on their own, especially at a small company. Hand-hold them through it if you have to. Your status depends on it.

DSO (Designated School Official) at a university here. A few things to add:

  • Make sure you report the STEM OPT extension application to your DSO. We need to update your SEVIS record and issue a new I-20 recommending the STEM extension. Don't file the I-765 without coordinating with your school's international office.
  • The I-983 Training Plan needs to describe how your employment is directly related to your STEM degree. For a CS degree working in software engineering, this is usually straightforward, but make sure the language is specific about learning objectives and mentorship.
  • You'll also need the employer to agree to the reporting requirements — they need to report to your DSO if your employment changes, and there are validation checks at 12 and 24 months.

Come to our office ASAP so we can get the I-20 updated. That also takes a few days and you don't want to be doing everything at the last minute.

Great news — my CEO completed the E-Verify enrollment yesterday and they got the company ID today. It really did only take a couple of days. I'm meeting with my DSO tomorrow to get the I-20 updated, and then I'll work with my employer on the I-983. Planning to file the I-765 by mid-March to give myself plenty of buffer before the April 22 deadline.
