I'm advising a client who wants to integrate Claude (Anthropic's AI) into their SaaS product. Need to understand the commercial terms better.

Specific questions:

  • Consumer (claude.ai) vs API terms - what's the difference for commercial use?
  • Who owns outputs when using the API commercially?
  • What's their usage policy around commercial applications?
  • When do you need an enterprise agreement vs standard API terms?

Anyone dealt with this?

Good summary. One final note: keep an eye on regulatory developments. The EU AI Act is coming into force gradually, and there may be disclosure requirements for AI-generated content that affect how your client needs to present their product honestly.

Also, Anthropic (like all AI providers) reserves the right to update their terms. Build in some flexibility for your client to adapt if policies change. Maybe include a provision in their agreements about AI provider terms being subject to change.
