Damages argument: If Anthropic can show that the designation was intended to cause commercial harm (which is essentially what a supply chain risk designation does — it's a government-issued warning to the market), but the actual market response was positive, it complicates the Pentagon's position. The designation looks more punitive than protective.

Public interest angle: The massive public support makes it harder for the government to argue that Anthropic's safety restrictions are out of step with public expectations. Good points all around. The historical parallel I keep thinking about is when Apple refused to build an FBI backdoor in 2016. That fight strengthened Apple's brand with privacy-conscious consumers and became a key part of their marketing for years afterward.

Anthropic may be building the same kind of brand equity here. "We'd rather lose Pentagon money than compromise on safety" is a powerful message for enterprise customers who care about responsible AI deployment — and that's a growing segment of the market.
