Has anyone dealt with something like this? I'm not sure what my options are.

open source code in commercial product. I've been dealing with this for about 9 weeks now and the situation isn't improving.

This involves original creative work over the past 9 months. I do not have documentation proving my ownership and timeline.

What are the risks if I pursue this? What's the likely timeline?

Based on what you've described, you likely have a viable claim under the DMCA safe harbor provisions. The standard is whether a reasonable person would find the conduct compliant with notice requirements.
