Independent Analysis of Connected Device Agreements
Smart home devices collect unprecedented amounts of data from inside your home—voice recordings, video footage, daily routines, and environmental data. Their Terms of Service govern who can access this intimate data and how it can be used.
Our attorneys have reviewed the complete Terms of Service for each major smart home platform, evaluating consumer fairness with special attention to privacy implications, law enforcement access, and data retention policies.

|---|---|---|---|---|
| Philips Hue Best in Category | 65/100 | B- | Cloud dependency for features | Limited data collected |
| Amazon Alexa | 58/100 | C+ | Always-on voice recording | With valid legal process |
| Google Nest | 52/100 | C | Google ecosystem data integration | With valid legal process |

Voice assistants are designed to continuously listen for wake words. Audio before and after wake word detection may be stored, analyzed by humans, and used for product improvement without explicit consent.
Most platforms will provide user data to law enforcement with valid legal process. Some platforms have active partnerships with police departments, enabling warrantless requests in "emergencies."
Security camera footage is stored in the cloud with varying retention periods. Users often don't realize footage may be retained even after deletion requests, or accessed by platform employees.
Most smart home devices require cloud connectivity to function. Companies can discontinue services, rendering expensive hardware useless. Local control options are limited or nonexistent.
Scores are based on my Consumer Fairness Index, which evaluates Terms of Service across multiple factors including readability, consumer rights preservation, data practices, and dispute resolution fairness. Smart home reviews additionally consider voice/video data retention, law enforcement cooperation policies, cloud dependency requirements, and device end-of-life policies. All reviews are conducted by licensed attorneys and updated when terms change.
