Legal Landscape: State Laws

While 48 states now have laws against non-consensual intimate images, these laws vary significantly. An NDA provides consistent protection regardless of which state's laws might apply.

California (Civ. Code 1708.85)

Civil liability for intentional distribution. Damages include economic, non-economic, and punitive damages plus attorney fees.

New York (Civ. Rights Law 52-b)

Civil cause of action with damages up to $250,000. Also criminal penalties under Penal Law.

Texas (Civ. Prac. & Rem. 98B)

Civil liability with statutory damages. Also a Class A misdemeanor under Penal Code.

Florida (Fla. Stat. 784.049)

Federal Law: SHIELD Act (Proposed) The SHIELD Act would create federal criminal penalties for non-consensual pornography. While not yet passed, this NDA will complement any future federal protections.
