📄 What is a 3-Day Notice to Pay Rent or Quit?
A 3-day notice to pay rent or quit is the required first step before a California landlord can file an unlawful detainer (eviction) lawsuit for nonpayment of rent. The notice gives the tenant exactly 3 days to either pay the overdue rent in full or vacate the premises.
⚠ Your Notice Must Be Perfect
California courts strictly scrutinize 3-day notices. A defective notice is the most common reason eviction cases get dismissed. Even minor errors - like including late fees in the amount, using the wrong date format, or improper service - can void your notice and force you to start over, costing weeks of delay and additional months of lost rent.
When to Use a 3-Day Notice
- Rent is past due - Tenant has failed to pay rent when due
- Grace period expired - Any contractual grace period has passed
- Partial payment - Tenant paid some but not all rent owed (new notice required for balance)
- Bounced check - Payment was returned for insufficient funds
Critical Requirements
✓ MUST Include
Only rent owed, tenant name, property address, where to pay, how to pay (cash/check/money order), landlord contact info
✗ Must NOT Include
Late fees, utilities, damages, attorney fees, interest, cleaning fees, or any non-rent charges
💡 Just Cause Requirements (AB 1482)
If your property is subject to the Tenant Protection Act (AB 1482 / Civil Code 1946.2), you may have additional notice requirements. Most single-family homes are exempt if properly noticed. I help landlords determine if just cause rules apply to their property.
⚖ California Law
I prepare 3-day notices that comply with all California statutory requirements. Here are the key laws governing this process.
Key California Statutes
CCP 1161 (Unlawful Detainer Grounds)
Establishes that a tenant is guilty of unlawful detainer when they fail to pay rent within 3 days after service of written notice. The notice must demand payment of the specific rent due or possession of the property.
CCP 1161.1 (Notice Requirements)
Specifies exactly what a 3-day notice must contain: amount of rent due, name/address/phone of person to pay, statement that rent may be paid personally or deposited, forms of payment accepted (must include personal check unless previously bounced).
CCP 1162 (Service of Notice)
Describes three valid methods of serving the 3-day notice: (1) personal delivery to tenant, (2) substitute service to someone at premises + mailing, or (3) posting and mailing if no one is available after reasonable attempts.
Civil Code 1946.2 (Just Cause for Eviction)
For covered properties under AB 1482, establishes that nonpayment of rent is a valid "at-fault just cause" for eviction. Landlords must still follow proper 3-day notice procedures before filing unlawful detainer.
What Your Notice MUST Include
| Required Element | Example |
|---|---|
| Tenant's full legal name (at least one adult) | "John Smith and all other occupants" |
| Complete property address | "123 Main Street, Apt 4B, Los Angeles, CA 90001" |
| Exact rent amount owed (rent ONLY) | "$2,500.00" |
| Payment location (name and address) | "ABC Property Management, 456 Oak Ave, Suite 100, LA CA 90002" |
| Landlord/agent contact information | Phone number where payment arrangements can be made |
| Accepted payment methods | "Cash, cashier's check, or money order" (or personal check if not bounced before) |
What Will INVALIDATE Your Notice
| Invalid Element | Why It Fails |
|---|---|
| Late fees included in amount | Not "rent" under CCP 1161 |
| Utility charges added | Not "rent" even if lease says so |
| Demanding more than actually owed | Overstating amount = automatic dismissal |
| Wrong tenant name | Must name at least one adult tenant correctly |
| Missing payment location address | Required by CCP 1161.1 |
| Refusing personal check (if no prior bounce) | Must offer personal check option |

Proper Service Methods (CCP 1162)
Hand the notice directly to the tenant. Get signed acknowledgment if possible. Keep detailed notes of date, time, and location.
If tenant unavailable, give notice to a competent adult at the premises who is informed of its contents, AND mail a copy to the tenant at the property address.
Only if no one is available after reasonable attempts: Post notice conspicuously on the property AND mail a copy. Document all attempts.
💡 Counting the 3 Days
The 3-day period begins the day AFTER service. Weekends and court holidays are excluded when counting. Example: Service on Monday = Day 1 is Tuesday, Day 2 is Wednesday, Day 3 is Thursday. If Day 3 falls on a weekend or holiday, extend to the next court day.

❓ Frequently Asked Questions
A valid California 3-day notice must include: (1) the full legal name of at least one adult tenant, (2) the property address, (3) the EXACT amount of rent owed (no late fees, utilities, or other charges), (4) the name, address, and phone number where payment can be made, (5) the name and address where rent can be paid in person, and (6) a statement that rent can be paid by cash, check, or money order. Missing any element can invalidate your notice.
California law (CCP 1162) allows three service methods: (1) Personal service - hand the notice directly to the tenant; (2) Substituted service - give it to a competent adult at the premises AND mail a copy; (3) Posting and mailing - if no one is home after reasonable attempts, post the notice conspicuously AND mail a copy. Keep proof of service for court. The 3 days begin the day AFTER service.
Yes, before you file the unlawful detainer lawsuit. Once the 3 days expire, the tenant loses the right to cure under the notice, but you are not required to accept late payment. However, if you accept any rent payment after the notice period, you may waive your right to proceed with eviction. Once you file the unlawful detainer, the tenant can still pay all rent plus costs to stop eviction.
Do NOT accept partial payments during the notice period. Accepting partial payment typically waives your right to evict based on that notice. You would need to serve a new 3-day notice for the remaining balance. If the tenant attempts partial payment, you can reject it and insist on full payment. Document any partial payment attempts in writing.
