A 3-day notice to pay rent or quit is the required first step before a California landlord can file an unlawful detainer (eviction) lawsuit for nonpayment of rent. The notice gives the tenant exactly 3 days to either pay the overdue rent in full or vacate the premises.

Proper Service Methods (CCP 1162)

Method 1
Personal Service (Best)

Hand the notice directly to the tenant. Get signed acknowledgment if possible. Keep detailed notes of date, time, and location.

Method 2
Substitute Service

If tenant unavailable, give notice to a competent adult at the premises who is informed of its contents, AND mail a copy to the tenant at the property address.

Method 3
Post and Mail

Only if no one is available after reasonable attempts: Post notice conspicuously on the property AND mail a copy. Document all attempts.

💡 Counting the 3 Days

The 3-day period begins the day AFTER service. Weekends and court holidays are excluded when counting. Example: Service on Monday = Day 1 is Tuesday, Day 2 is Wednesday, Day 3 is Thursday. If Day 3 falls on a weekend or holiday, extend to the next court day.

What must a California 3-day notice include?

A valid California 3-day notice must include: (1) the full legal name of at least one adult tenant, (2) the property address, (3) the EXACT amount of rent owed (no late fees, utilities, or other charges), (4) the name, address, and phone number where payment can be made, (5) the name and address where rent can be paid in person, and (6) a statement that rent can be paid by cash, check, or money order. How do I properly serve a 3-day notice?

California law (CCP 1162) allows three service methods: (1) Personal service - hand the notice directly to the tenant; (2) Substituted service - give it to a competent adult at the premises AND mail a copy; (3) Posting and mailing - if no one is home after reasonable attempts, post the notice conspicuously AND mail a copy. Can the tenant cure by paying rent after the notice expires?

Yes, before you file the unlawful detainer lawsuit. Once the 3 days expire, the tenant loses the right to cure under the notice, but you are not required to accept late payment. However, if you accept any rent payment after the notice period, you may waive your right to proceed with eviction. Once you file the unlawful detainer, the tenant can still pay all rent plus costs to stop eviction.

What if my tenant makes a partial payment?

Do NOT accept partial payments during the notice period. Accepting partial payment typically waives your right to evict based on that notice. You would need to serve a new 3-day notice for the remaining balance. If the tenant attempts partial payment, you can reject it and insist on full payment. Document any partial payment attempts in writing.
