Landlord raising my Santa Monica rent by 8% - is this legal under rent control?

I rent a 1BR in Santa Monica for $3,200/month. Been here 2 years. Landlord just gave me a 60-day notice of an 8% rent increase to $3,456.

I thought Santa Monica had strict rent control? Isn't 8% too high? What's the actual legal maximum I can be charged?

Santa Monica has some of the strictest rent control in California. Under the city's Rent Control Charter Amendment, annual increases are limited to 75% of the CPI (Consumer Price Index).

For 2025, the LA metro CPI is approximately 3.5%, so Santa Monica's maximum allowable increase is:

  • 75% × 3.5% = 2.625% maximum
  • On $3,200 rent = $84 maximum increase to $3,284

Your landlord's proposed $256 increase (8%) is more than TRIPLE the legal maximum. This increase is illegal.

Correct - you only pay the legal maximum ($3,284). Send your landlord a letter citing Santa Monica Rent Control Charter Amendment and the correct calculation.

If he tries to evict you for "nonpayment" when you're paying the lawful rent, that's illegal and you'll win in court. He also can't evict you in retaliation for asserting your rent control rights (California Civil Code 1942.5).

File a complaint with the Santa Monica Rent Control Board. They enforce these violations and can order your landlord to refund any excess charged.

I've dealt with this exact situation. Santa Monica Rent Control Board is VERY tenant-friendly. They'll investigate, order a rollback, and potentially fine your landlord.

Document everything - the illegal notice, your communications, and when you started paying the correct lawful rent. SM Rent Board website has forms to file complaints.

Check if your unit is covered: buildings with a certificate of occupancy issued before April 10, 1979 are generally covered. Condos, single-family homes, and newer construction may be exempt.

If your unit IS covered, respond to your landlord in writing citing the Santa Monica Rent Control Charter Amendment. You can also file a complaint directly with the Rent Control Board — they're surprisingly responsive and can order a rollback.

One important nuance: Santa Monica allows landlords to petition for an "individual rent adjustment" above the general increase if they can demonstrate increased operating costs (capital improvements, maintenance expenses, property tax increases). This requires a formal petition and hearing before the Rent Control Board.

If your landlord just sent you a notice of 8% increase without going through this process, it's likely invalid. Even if they did petition, you'd have the right to appear at the hearing and contest it. The Board rarely grants increases as high as 8%.

Also worth noting: Santa Monica has mandatory relocation assistance if the landlord tries to evict you for refusing an illegal rent increase. The amounts are substantial — $10K-$20K+ depending on unit size and tenant category.
