For fellow Texans finding this thread, here's the winning formula:

  • Certified demand letter citing Texas Health Spa Act (Tex. Occ. Code 702) AND the DTPA
  • Specifically mention treble damages under DTPA Section 17.50(b)(1)
  • File TX AG complaint simultaneously
  • Call and ask for "Executive Resolution" or "Member Services Executive"

The DTPA is no joke - Texas gyms know that treble damages plus attorney's fees makes it worth a lawyer's time to take these cases. They'd rather settle quietly than risk that exposure.
