Looking for advice on a legal issue. Here's what happened.

financial advisor churning account. I've been dealing with this for about 16 weeks now and the situation isn't improving.

I have already tried to resolve this directly but the other party is not cooperating.

Do I have a strong case? What should my next steps be?

This is depressingly common.

I ended up filing with the appropriate government agency, which cost about $4-8 but saved me a lot more in the long run.

This happened to me too. Have you tried filing a complaint with the relevant agency? In my case they investigated and it got resolved without needing a lawyer.

For anyone in California: look into the Private Attorney General Act (PAGA). It allows employees to file lawsuits on behalf of the state for Labor Code violations. The penalties can be substantial and it's a powerful tool that's unique to California.

Update: successfully resolved my dispute through arbitration. Total time from filing to award was about 4 months. The arbitrator awarded me the full amount plus attorney fees because the contract had a prevailing party clause. Always check if your contract has fee-shifting provisions.

I just learned that indemnification clauses can be mutual or one-sided. Always push for mutual indemnification — if they want you to indemnify them, they should indemnify you too. It's basic fairness.
