Is the vendor truly a “third party”?

If the vendor:

  • only processes data as your service provider, under contract,
  • cannot use the data for its own unrelated purposes, and
  • is technically integrated in a way that looks like first-party processing,

Map the tech and the data flows

  • For each tool, document:
    • exactly what gets captured (URLs, keystrokes, audio, chat),
    • where it goes (first-party server vs vendor cloud), and
    • whether the vendor can reuse it for anything beyond your account.

Do we really need “two-party consent” pop-ups for every chat widget on our site?

Not necessarily — but you do need consent that is defensible under § 631/632.

Best practice for public-facing chat:
